EBay Bootlegger Alert

That South American scam artist is on EBay again. This time, he is selling a copy of the concert from Nancy from February 28, 2009. Please try to report this to EBay.

  3. it is pulled and i am pretty sure it was my matrix recording i did with juhab.. thank you folks..

    and please keep in mind there will be always people bidding for these items .. as not everybody knows about filesharing and trading.. the world is a big place

So, let me see if I have this right- it is okay to take someone else's music and post it for free for others to download, but it is not okay to take that same music and try to package and sell it? Is there some sort of ethics here that I am not aware of? That not selling it makes it okay, but selling it does not, when in both cases it does not belong to you and is not your to take? "Cause I am confused here. Is the transfer of money the only issue that matters?

  5. Well, if you already know the music is not yours, why would you want to gain money from it?

    Most bands are actually open about bootlegging (which isn't the same as piracy, mind you), as long as no one profits from it. That's also the opinion of Christian Vander, as far as I know...

  6. First case, we have a group of sincerely passionate people trying to share their love for this music, trying to enlarge the audience for the benefit of the group without retiring from it any personal advantage.

    Second case, we have an isolated person acquiring freely some music recorded by others and trying to obtain a benefice of it for himself while misleading potential buyers with a false "official record".

    Don't you really see the difference ?

  8. So it is simply your motive that matters? Because you are a fan and wish to evangelize your favorite band, then it is okay to take the music and post it? I am not sure I really see any difference here, and unless you have personal knowledge of Christian Vander (and more likely Stella- and have it in writing), I doubt that it is okay to just go and do this. Look, I understand the love, I do, but I do not understand why that gives you permission to take music that is not yours to take. I write books. Should it then be okay for someone to take my book that they love and post it somewhere so others can read it just because they love my work? My work is what pays my bills, you know?

    Actually as I understand it Stella reads this blog frequently, where announcements of new recordings are posted. If they didn't want us to have these audience made recordings they could have easily put a stop to it. With Dimeadozen, it says on the policy page that any artist that doesn't want recordings made at their concerts featured on the site just have to tell the site and they will pull all recordings. It's actually fairly common now that bands allow taping of their concerts, unless the concert was also recorded professionally, by the band, for commercial release. People act like it is stealing but it is just capturing those short few hours of music which, after the band has played it, have nothing more to do with it.

    magma gets paid by the audience thru the entrance fee.. the later distribution of the recorded event doesn't seem to bother anybody in the magma camp but YOU.. you just stay away from private recordings and your life should be fine..... simple as that ....
